South Dakota to Discuss Daily Fantasy Sports Legality on Wednesday

While it is a state with a small population, South Dakota Attorney General Marty Jackley issued a statement Friday saying there will be a meeting on Wednesday to determine how his state should respond to New York’s Attorney General Eric Schneiderman’s declaration that Daily Fantasy Sports is a form of illegal gambling.

“Federal law, the state in which a wager is made and the state in which a wager is received may have jurisdiction over the matter,” he said on the news release.

“It has traditionally been the position of the South Dakota attorney general’s office that pursuant to South Dakota law, games of skill are exempted from the state law prohibition.”

Representatives for both DraftKings and FanDuel, the two companies singled out by Schneiderman, insist what they do is a “game of skill” rather than a “game of chance”.

Jackley said he gave this summary of state law without pronouncing on the legality of fantasy sports betting itself.

Jackley will leave the matter in the hands of the State Gaming Commission, which is slated to meet Wednesday at 9 am in the Deadwood city hall.
